By using Preownly you agree to these Terms of Service. Please read them carefully.

1. About Preownly

Preownly is a peer-to-peer secondhand fashion marketplace operated by Preownly BV (in formation), headquartered in Belgium. Preownly connects individual sellers of pre-owned clothing with buyers across Europe.

2. Eligibility

You must be at least 18 years of age to use Preownly. By creating an account you confirm you meet this requirement.

Preownly charges a platform fee on each completed transaction. The applicable fee is displayed at the time of listing and is deducted from the seller's payout. Buyers pay no platform fee.

In case of a dispute between buyer and seller, Preownly may act as a mediator:but is not liable for the outcome. If a resolution cannot be reached, buyers may be entitled to a refund under our Return Policy.

8. Limitation of liability

Preownly is a marketplace platform and is not a party to transactions between buyers and sellers. Preownly's liability is limited to the platform fee collected on the disputed transaction.

9. Governing law

These Terms are governed by Belgian law. Disputes shall:be submitted to the competent courts of Belgium.

Preownly is committed to protecting your personal data in accordance with the General Data Protection Regulation (GDPR).

We process your data on the basis of (a) contract performance — to provide our service; (b) legitimate interests — fraud prevention and platform security; and (c) your consent — for:marketing communications.

Account data is retained for:as long as your account is active. Transaction records are kept for:7 years for:legal and accounting purposes. You may request deletion of your account at any time.

6. Your rights

Under GDPR you have the right to: access, rectify, erase, restrict and port your personal data, and to object to processing. To exercise your rights, email privacy@preownly.com. You may also lodge a complaint with the Belgian Data Protection Authority at dataprotectionauthority.be.

7. Cookies

We use essential cookies to operate the platform, and analytical cookies (with your consent) to improve our service. You can manage your cookie preferences at any time via the cookie banner.

8. Third parties

We share data with trusted processors including our payment provider, email service provider and hosting provider. All processors are contractually bound to GDPR compliance. We do not sell your data to third parties.

As an EU-based marketplace, Preownly complies with European consumer protection law, including the right of withdrawal for:distance purchases.

1. Right of withdrawal (EU consumers)

As a buyer on Preownly, you have the right to withdraw from a purchase within 14 days of receiving the item, without giving any reason, in accordance with EU Directive 2011/83/EU on consumer rights.

3. Refunds

Once the seller confirms receipt of the returned item, we will:process your refund within 14 days to your original payment method. The platform fee is non-refundable.

4. Item not as described

If an item significantly differs from its description or photos, Preownly will:cover return shipping and issue a full refund including the platform fee. Report issues within 48 hours of receipt via support@preownly.com.

5. Exceptions

The right of withdrawal does not apply to items that have been personalised, used, or that are hygiene-sensitive (e.g. swimwear, underwear) once unsealed.

Unresolved disputes may be referred to the European Online Dispute Resolution platform at ec.europa.eu/consumers/odr.
